Terms of Service

These Terms of Service govern your access to and use of the Lapel Love website, including its content, accounts, products, checkout, custom pin inquiries, and related services (collectively, the “Service”). The Service is operated by Lapel Love LLC (“Lapel Love,” “we,” “us,” or “our”).

Please read these Terms carefully. By accessing or using the Service, you agree to these Terms and any policies incorporated by reference. If you do not agree, do not use the Service.

Our Privacy Policy explains how we collect, use, and disclose personal information and is incorporated into these Terms. Purchases are also subject to our Shipping & Returns Policy and any product, custom order, promotion, or checkout terms presented when you place an order. If additional terms conflict with these Terms, the additional terms control for that specific feature or transaction.

You may browse without creating an account. If you create one, you agree to provide accurate, current information and keep it updated. You are responsible for safeguarding your password and for activity under your account.

Notify us promptly at support@lapellove.com if you suspect unauthorized access. We may suspend or close an account when reasonably necessary to protect the Service, enforce these Terms, or address inaccurate or fraudulent information.

We try to describe and display products accurately, but colors, scale, and appearance may vary by screen or production run. Product descriptions do not create a warranty unless we expressly state otherwise in writing.

Products, prices, promotions, and availability may change without notice. Prices are shown in U.S. dollars unless stated otherwise. Placing an order is an offer to purchase. We may accept, decline, limit, or cancel an order for reasons including unavailable inventory, pricing or description errors, suspected fraud, payment issues, or suspected resale or misuse. If we cancel after charging you, we will issue an appropriate refund.

You represent that your order and payment information is accurate and that you are authorized to use the payment method submitted. Payment processing is provided by Stripe and may be subject to Stripe’s terms.

We ship to destinations shown at checkout. Shipping charges and estimated delivery windows are displayed before purchase or described in our Shipping & Returns Policy. Delivery dates are estimates and may be affected by carriers, customs, weather, peak periods, address problems, and events outside our reasonable control.

Online checkout currently accepts United States shipping addresses. You are responsible for providing a complete, deliverable address.

Ready-made products may be returned only when they satisfy the eligibility, condition, timing, and process requirements in our Shipping & Returns Policy. Custom products are generally not returnable after design approval except when defective or otherwise required by law. Contact support@lapellove.com with your order number to request assistance. Nothing in these Terms limits non-waivable consumer rights.

A quote request is not a production order or guarantee of price, availability, or completion date. Custom work begins only after we confirm specifications, pricing, payment, artwork approval, and production terms.

You retain ownership of artwork you submit. You grant Lapel Love a limited, nonexclusive license to receive, store, review, reproduce, resize, convert, and share that artwork with personnel and production providers solely as needed to quote, prepare, manufacture, fulfill, and support your requested project.

You represent that you own or have permission to use all submitted names, logos, characters, images, trademarks, and other materials. You may not request material that infringes another person’s rights or violates law. We may decline or cancel a project we reasonably believe presents legal, safety, production, or reputational concerns.

The Service and its content, including Lapel Love branding, site design, text, graphics, photographs, product designs, and software, are owned by Lapel Love or its licensors and protected by intellectual property laws.

We grant you a limited, revocable, nonexclusive, nontransferable right to use the Service for personal, lawful purposes. You may not copy, reproduce, modify, distribute, sell, create derivative works from, scrape, or commercially exploit the Service or its content without written permission, except as allowed by law.

You may not use the Service to:

• Violate law or another person’s rights.
• Submit false, fraudulent, infringing, harmful, or malicious material.
• Impersonate another person or misrepresent your affiliation.
• Interfere with the Service, bypass security, probe vulnerabilities, or introduce malicious code.
• Use automated systems to scrape content, overload infrastructure, manipulate inventory, or make unauthorized purchases.

We may restrict access or take other reasonable action to investigate or prevent misuse.

The Service may link to or rely on services operated by others, including payment, shipping, social media, and application providers. Their services and content are governed by their own terms and policies. We do not control and are not responsible for third-party websites or services, except to the extent required by law.

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will always be uninterrupted, secure, error-free, or that every product will remain available. These disclaimers do not apply where prohibited by law or to any express product commitment we make in writing.

To the fullest extent permitted by law, Lapel Love and its members, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunity arising from the Service or a purchase. Our aggregate liability for a claim relating to a product or transaction will not exceed the amount you paid for the product or transaction giving rise to the claim. Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Lapel Love and its members, employees, contractors, and agents from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful misuse of the Service, your violation of these Terms, or artwork or materials you submit that infringe another person’s rights. This section does not require indemnification for Lapel Love’s own unlawful conduct.

These Terms and your use of the Service are governed by the laws of the State of California, without regard to conflict-of-law principles. Nothing in these Terms deprives you of mandatory protections available under applicable consumer law.

If any provision of these Terms is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later.

We may update these Terms as the Service or legal requirements change. We will post the revised Terms here and update the last modified date. Your continued use after revised Terms take effect means you accept them, except where additional notice or consent is required by law.
